LEGAL LIABILITY IN THE PROVISION OF SOCIAL SERVICES

The article deals with the topic of legal responsibility in the provision of social services, particularly with an emphasis on private liability and, in its practical part, on the issue of legal awareness of individual providers regarding liability matters. The paper aims to characterize the specifics of the legal responsibility with provision of social services as opposed to general types of legal responsibility. The article points to the conclusion of selected judicial decisions clarifying the specific scope of the provider’s responsibility. The accompanying research focuses mainly on the issue of practical experience with the topic of legal liability and the exercise of claims from legal liability against a social service provider and the legal awareness of social service providers in the given area. The research shows rather marginal experience with cases of actual exercise of liability for damage in the provision of social services (92% of respondents have not encountered this), but at the same time also relatively low legal awareness in the given area (approx. 52% of respondents do not consider the content of the legal regulation in the area of liability relations to be clear and approx. 44% of respondents stated that their employees are not briefed in the area of liability relations). It can be summarized that the state of legal awareness in the area of possible interference with the personal rights of clients or other damage caused to clients is not sufficient among social service providers.
